TheAppeal Courtsitting in Owerri, yesterday after adopting the briefs of argument brought before it by the counsel to the dissolved local government elected council members as the appliance and the counsel to the state government led by Governor Rochas Okorocha as the respondents adjourned to a date that will be communicated to the concerned parties for judgment.
However before adopting the brief of argument a cross appeal filed by the counsel to the state government Chief Akintola (SAN) praying the Court to dismiss the case because the dissolved council members do not have any Locus Standi to go into the election in the first place because there was court injunction against the said election that produced them, which invariably made their positions null and void.
In his reply to the argument, the counsel to the dissolved council members Chief Livy Uzonkwu (SAN) faulted the cross appeal stated authorities and defining and referring to the cross appeal as being empty according law. When Barr. (Mrs) Bola, holding brief for Chief Akintola (SAN) was asked by the presiding Judges if she has any contrary and counter, she could not say anything in counter.
Hon Justice Abba Aji led panel, after listening to the parties argument and adoption of their different briefs adjourned the case for judgment to a date that will be communicated to the two parties.
