A clearer picture of who is entitled to represent Ohaji/Egbema State Constituency in Imo State House of Assembly will emerge today as the Appeal court in Owerri decides on the matter. The former Speaker of the Imo State House of Assembly, Rt Hon Goodluck Nanah Opiah had gone to court asking the Independent Electoral Commission, INEC to, to issue him Certificate of Return based on the fact that he won the April 26, 2011 election.
Chief Opiah had after the May 6, 2011 Supplementary Election, where the APGA candidate, Chief Luke Chukwu was declared winner, went to a Federal High Court in Owerri asking INEC to issue him Certificate of Return after he had been issued with a Declarative Result to indicate that election was conducted and concluded on April 26, 2011.
As part of the reason adduced by counsel to Opiah for the request, the April 26 Election was won by the PDP as the result declared by the Electoral officers and Returning officer showed which necessitated his receipt of the Declarative Result.
The Federal High Court in its earlier ruling declared that it has no jurisdiction to hear the matter, prompting Opiah to approach theAppeal Courtfor justice.
