Hon. Justice Duruoha Igwe has rejected Bar. Chris Ahumibe to appear as a defendant in a case he is counsel to, which is against law ethics. This came after the counsel to the claimant Bar D.O.Agbo had objected to the counsel appearing as a defendant/respondent.
Although, Bar. Ahumibe argued that there is no law in the civil procedure that prohibits a lawyer in his position not to stand for himself and others. However, the presiding judge agreed that the defendant in his capacity cannot address the court from the Bar.
Due to no proof of payment for motion, the hearing could not continue but was adjourned to the 11th of July 2012.
It will be recall that, it was the government of Achike Udenwa in 2005 allocated the 26 hectares of land to Umuehieta village in Avu community, in fulfilment of government policy on resettlement of people whose land were acquired by government for public purpose.
