The Imo State Election Petition Tribunal sitting in Owerri on the 1st of July, 2015, in a case EPT/IM/HR/06/2015 overruled itself nullifying its earlier ruling permitting amendments in a petition against the member representing the Ohaji/Egbema/Oguta/Oru West Federal Constituency, the Rt Hon Goodluck Nanah Opiah.
The immediate past member in the Imo State House of Assembly for Oru West State constituency who contested for the Federal Constituency but lost had challenged the victory of Rt Hon Opiah without due diligence, adequate research in records, evidence and facts.
However, upon realizing the mistake, petitioner Ozoemena had through his counsel sought amendment of the original petition without recourse to the requirements of the Electoral Act.
After exchange of legal fireworks between the legal team of Chief Ozoemena led by BC Iheka Esq and that of Rt Hon Opiah led by the duo of De-Nwigwe (SAN) and KCO Njemanze (SAN), the tribunal saw reason to nullify its earlier ruling permitting amendments in the petition against Rt Hon Goodluck Opiah. The action threw wild jubilation in the camp of Opiah who thronged the court premises while Ozoemena people left disappointed.
