The legal battle between the Government of Imo state and 10,000 (Ten Thousand) job beneficiaries continued at the National Industrial Court Enugu, as the Court has thrown out the motion filed by Imo state Government stopping the trial of the case.
The Government has also been served a fresh notice on interlocutory injunction stopping the Owelle Rochas Okorocha administration from filling the positions of the embattled beneficiaries while the legal battle rages in court.
At the Industrial Court sitting in Enugu on 7th November, the Court overruled Imo Government’s motion and declared that it has the locus to hear the matter proper and therefore fixed Jan 23, 2013 as date for the hearing of main case.
The Okorocha Government had in February challenged the jurisdiction of the Industrial Court to entertain the matter.
The Industrial Court overruled the matter, saying it has the locus standi to hear the matter and Imo Government appealed, and the Appeal Court ruled in favour of the embattled job seekers.
Then Imo state Government sought a stay of proceedings motion, which was filed on October11, 2012. Buts ruling on the matter on Wednesday 7, November, the Court averred that it will go on with the proceedings and therefore fixed next year January 23, as date for the trial to commence.
However, the 10,000 job seekers went further to sought for interlocutory injunction restraining the Government from filling the positions while the matter goes on in the Court.
