Judiciary Intervenes In APGA Guber War Court Stops Capt Emma Ihenacho’s Screening

The unsavoury developments ravaging the Imo state arm of the All Progressive Grand Alliance, APGA reached a feverish pitch on Tuesday when the law court became involved in determining the date of the screening of the aspirants.
While the dust raised by one Chief Sam Ahanonu, who took on a frontline governorship aspirant, Capt Emmanuel Ihenacho is yet to settle, another party stalwart Kennedy Onyemara has added another interesting drama into the unfolding scenario.
Upon an application by Motion Exparte filed in the High Court Registry, Etiti on the 17th day of November 2014 and brought pursuant to order 7 Rule 5 (1) of the Imo State High Court (Civil Procedure Rules) 2008, and section 96 of the sheriffs and Civil Process Act, the judge while ruling, ordered, “that the parties are restrained from doing anything that will destroy or prejudice the subject matter of this suit till the interim injunction application is disposed of”
Onyemara, who claimed to be a member of APGA asked the court in his Motion Exparte to stop APGA from screening Capt Ihenacho on the basis that he is not a registered party member of APGA and should not be granted certain favours like screening as a governorship aspirant.
APGA screening exercise for governorship aspirants is scheduled for today Nov 20 and Friday Nov 21. While the matter was adjourned to the 25th day of November 2014.
In view of the 25th day of November adjourned date for the next hearing of the matter and the days stipulated for the screening, the ambition of Capt Ihenacho may suffer hitches in his quest to pick APGA ticket.
According to E.A Agada, the judge in suit No HME/64/2014, having read the motion paper, the affidavit in support, the written address and after hearing Ukpai Ukairo, Esq with Kalu Kalu Esq for the claimant/Applicant, he ordered as follows “That leave is hereby granted the Claimant/Applicant to serve the write of summons and all other processes in this suit outside jurisdiction on the 1st Defendant/respondent at its Head Office at 416 Libreville Crescent opposite Tulip Press Aminu Kano Crescent Wuse II Abuja.
“That leave is also granted the Claimant/Applicant to serve the originating process and all other processes, order or documents on the Defendants by substituted means, to wit, that is to say, by publication in the Newspaper in a national newspaper like “The Sun” or “The Guardian” or “This Day’
“That such service shall be deemed good and proper service of the said processes on the defendants accordingly.
“It is further ordered that this case is adjourned to 25th day of November 2014”.
